Abolish Earmarks

For some time I have been internally conflicted on the issue of congressional earmarking. Many people, including such diverse characters as President Obama and Congressman Chaffetz, have been vocal about calling for an end to earmarks. Others such as my own Congressman, Rob Bishop, reply that earmarks are not an addition to the total size of our federal expenditures – but simply a direction regarding the spending of money already appropriated. Believers in small government who make that argument say that our focus should be on reducing total expenditures rather than shutting down the earmarking process. Personally, I would like to see an end to earmarking and a significant reduction in total spending. (Earmarks alone are an insignificant portion of our spending.)

The Health Care Issue as a Catalyst for Debate

When I saw that Jim DeMint had written an article titled Our Health Care Mess Is a Symptom of a Much Bigger Problem my interest was piqued partly because I like DeMint as a senator and partly because I had just been saying the same thing in a series of comments with a reader from New York. It was exactly as DeMint predicted in his final paragraph:

The current debate over health care reform is a symptom of a bigger problem in Washington. But it can be the catalyst for a wider debate about the proper role of government in our lives.

The comments I was receiving demonstrated exactly what DeMint was talking about when he said:

All of these things have happened because we’ve stopped asking, “Should government attempt to solve this problem?” Instead, we start by asking, “How should government fix the problem?” It’s now considered a sign of admirable restraint to occasionally ask, “How much should we spend?” And somehow we started thinking that anything less than a trillion dollars is a bargain. (emphasis mine)

We can’t expect to come up with the right answer when we start by asking the wrong question. For too long we have been asking only how the government should fix our problems and not if the government has any business fixing those problems. Obviously there are some problems that the government should fix, but there are many that it should not address.

Because er have been asking ourselves the wrong question we find ourselves as a nation in this situation:

There’s not a word in the Constitution about the government deciding what medical tests private health insurers should pay for. Nothing about the government deciding how much executives on Wall Street should earn, or what kind of light bulbs and cars we should buy. There’s nothing about the thousands of parochial earmarks that fund local bridges to nowhere, golf courses, bike paths, sewer plants, and tea pot museums.

There’s nothing about these or many other things in the Constitution because they have nothing to do with the proper role of a federal government in a free society. But these are exactly the kinds of things our government spends its time and money on, and we don’t even question anymore why that is.

As the length of that list indicates we have had many opportunities to ask the right question. Hopefully health care will be the issue where we finally step back and ask the right question. Once we ask the right question we will begin to understand the truth that:

It matters because every time we give a job to the government, we take away some control that people have over their lives, and we take away a little bit more of their freedom. In return for letting government try its hand at solving a problem, we as citizens cede our ability to try for ourselves to find a better way.

It’s awkward to admit it, but my colleagues in Congress have led this country into the woods despite our oath of office. We swore to protect and defend the Constitution of the United States and to bear true faith and allegiance to it. The Constitution prescribes a very limited role for the federal government. There is not a word in our oath, or in the Constitution, about most of what we do. As we’ve wandered off the path of liberty, there are few crumbs left of the Constitution in the halls of Congress to lead us out of the woods. (emphasis mine)

If we honestly ask the right question we will undoubtedly reach some uncomfortable conclusions such as the fact that the government has already overstepped its bounds with things we would rather not alter, like Social Security and Medicaid/Medicare, but if we continue to shut our eyes to that primary question there will be no way to reverse our downward spiral, the best we could ever manage to do is quit digging the hole deeper.

Of Big Tents and Purity

It’s a busy holiday time so I’ll spend more time quoting and less time expounding. Back in May, Jim DeMint expressed the very opinion I still hold about How Republicans Can Build a Big-Tent Party by holding to one key principle:

There is a question Republicans do need to ask: What is it that binds our party together?

. . . Moderate Republicans are right to remind conservatives that they cannot build a center-right coalition without the center part. And conservatives are right to remind moderates that Republicans only succeed when we rally around clear principles.

The real mistake is that Republicans became more concerned with staying in D.C. than reforming it.

Despite notable successes at both ends of Pennsylvania Ave., it seems to me that Republicans in Congress and in the Bush administration forgot a simple truth. To paraphrase C.S. Lewis, if you aim for principled reform, you win elections in the bargain; if you just aim for elections, you get neither.

No Child Left Behind didn’t win us “soccer moms,” but it did cost us our credibility on locally controlled education. Medicare prescription drugs didn’t win us a “permanent majority,” but it cost us our credibility on entitlement reform. Every year, another Republican quality was tainted: managerial competence, fiscal discipline and personal ethics.

To win back the trust of the American people, we must be a “big tent” party. But big tents need strong poles, and the strongest pole of our party — the organizing principle and the crucial alternative to the Democrats — must be freedom.

We’ve been discussing the ideas of purity, conservatism, inclusiveness, and intra-party division a lot in the last few months. I believe, along with many of you, that holding to principle and being inclusive are not mutually exclusive goals. There must be strong poles to hold the tent up, or to put it another way, there must be something in the tent that makes people want to enter. I agree with Senator DeMint that freedom would be a very enticing offering – but we have to find a way to articulate the vision of freedom and not allow the message to by framed in negative terms by those who disagree with our vision.

Term Limits for All

One year ago today I pointed out that the subject of term limits becomes popular after an election. Like clockwork it came up again this year. Jim DeMint jumped the gun a bit by announcing three weeks ago that he would introduce a term limit amendment. Yesterday he introduced the bill and today I read an opinion by Mark Tapscott on why he thinks it will actually happen this time.

In previous posts on the subject we have usually had some good discussions, but they tend to be the same from year to year. I’ll summarize the previous discussions in hopes that we can start a step or two down the road and have a more advanced discussion by doing so.

The discussion  that we usually have boils down to the fact that term limits deal more with a symptom of our broken system rather than a cause but that treating that symptom might help to promote the curing of some of the underlying causes. Those who oppose term limits often argue that the people should be free to keep their same representatives as long as they want – but that thinking seems to obscure the fact that the position should always be greater than the person holding it and that society and the political system benefits from regular turnover so that we can’t mistakenly think that the junior senate seat from Utah somehow belongs to Bob Bennett, or that the senior senate seat from Massachusetts was some inalienable right for Ted Kennedy until his death.

Senator Jim DeMint on Term Limits

I started a discussion on term limits a couple of years ago on this site and between what I said then and what I have said on other sites I think my position on term limits is fairly clear – I believe that term limits generally produce benefits that far outweigh the drawbacks that opponents will cite. I think solid evidence of that is that not one state (out of 15) that has enacted a term limit law and had it start limiting terms has ever repealed their term limit law. (Six states did enact laws and then repeal them before they took effect – including Utah.) Coming from that position, I was happy to hear the announcement from Senator Jim DeMint that he plans to introduce a term limits amendment soon.

While I have some questions about some of the specifics of what he plans to propose like how he decided that three terms would be the appropriate limit for members of the House or how flexible he would be on the particular limits he is proposing, I found one statement that he made very insightful about the last time that term limits were seriously pursued by the political class.

Fifteen years ago, Republicans – who had been out of power in Congress for forty years – made term limits a centerpiece of their “Contract with America” agenda.

The term limits constitutional amendment ultimately failed, in part because so many new reform-minded congressmen imposed term limits on themselves. After six or eight years, these members voluntarily went home, leaving behind those Republicans and Democrats who fully intended to make a career inside the beltway.

The fact is, party doesn’t matter when it comes to reform. If you want to change the policies, you have to change the process.

He’s absolutely right that no significant reform will come in how Washington operates until we make structural changes that force it to operate differently. His comment that many of those who wanted to enact term limits voluntarily term-limited themselves – thus crippling the attempt by leaving it in the hands of those who had no interested in being term limited was insightful. I realized that anyone who wants to make such a change would have to take the attitude and make a pledge to stay in Washington as long as possible until they either got term limits enacted or else until they no longer believed that term limits were worth pursuing. Those who will impose their own limits independent of everybody else will limit their own comparative effectiveness by granting more power to those who do not believe in their ideals (specifically the ideal of having term limits).

Under-Informed Health Care Debate

Considering how widely discussed the health care issue is and how long running that discussion has been it is easy for people to think they have all the available and relevant information on the subject. The fact is that despite the appearance of coverage you can only scratch the surface of available information unless you search beyond mainstream news sources. Here’s a letter in the  Salt Lake Tribune yesterday as a case in point:

To President Barack Obama and Congress, I say: Negotiate the various health care reform bills — soon. Get the Blue Dog Democrats on board, and pass a bill — soon, before your public becomes so weary of partisan infighting that we oppose anything you pass.

The Republicans, for all their bluster, have not offered any alternative, except our Sen. Bob Bennett with Oregon Democrat Sen. Ron Wyden, and that bill has received only token Republican support. . .

The author is right that the Health Americans Act by Wyden and Bennett has received only token Republican support – largely because it is only fleetingly different from the various Democrat only bills in circulation. On the other hand, he is far from right that Republicans have offered no alternatives – that’s just the line that Congressional leaders and the administration have been feeding to the media. Just browse the sites of Rep. Ron Paul and Sen. Jim DeMint to get an idea of some of the Republican counter-proposals that have been offered. Then consider that for every idea presented by those two members of Congress there must be dozens of ideas that were offered in negotiations before the Republicans left the tables that never received even token consideration by leaders of the various committees.

On the very day the letter was being published Rep. John Shadegg (AZ-03) was talking about one of those non-existent Republican plans that was apparently introduced back in July and cosponsored by Rep. Rob Bishop (UT-01) among others. (h/t Right Truth) As always in the health care debate, each bill should be measured against the findings of David Goldhill to see if it actually addresses the real problems in the health care system. (Shadegg’s bill appears to do better than the bills actually acknowledged by the media from what I’ve seen.)

Although I maintain that being truly informed requires that we look at more information sources than the mainstream media that also means that we have to be discerning about the accuracy of each information source. I think it’s safe to doubt the accuracy of anyone (especially an MD) that believes that our current health care system suffers from a “lack of government regulation.” I’m amazed that someone could seriously argue that the current proposals under consideration represent free market solutions and that solutions based on free market principles would be a good thing while also arguing that the free market is the cause of our health care woes.

Nobody Wants the Status Quo

Proponents of the current health care proposals charge that those who oppose these proposals only want the status quo. No honest Democrats have stepped forward to admit the truth that opponents of these measures have been offering alternatives and decrying the status quo. The leader among dishonest Democrats today is none other than President Obama (whom I have tried to refrain from specifically criticizing) who not only will not admit the truth about opponents of his preferred reform package but who goes further by holding “town hall meetings” where no opportunity for discussion is even considered (as do many of his followers) – these are not chances to discuss and enlarge public understanding of the issue, they are opportunities to indoctrinate the masses one town hall at a time.

Nothing I have said excuses the behavior of some protesters at many town hall meetings who are equally disinterested in any actual discussion, but any real leader would have to rise above such rabble and be willing to engage and explain rather than pontificate and cajole.

Among those speaking against the current reform proposals there is a common belief that has never been addressed by backers of the proposals – that the current prescription will actually be worse than the status quo (which they agree is not an acceptable situation). Not only are they speaking against the dangerous potential of the current direction but here are a few of the ideas that are not being offered to considered by our current leaders.
