Marionette Bob Bennett

While candidate Mike Lee acted like a senator on the issue of confirming Ben Bernanke for another term as chairman of the Federal Reserve Board, Bob Bennett acted like a marionette under the control of the mystical wizard of Washington D.C. With a short press release and a predictable vote, our “Senator” Bob Bennett plainly demonstrated the cancerous logic that is rampant among Washington insiders. Here is how he justified his vote to confirm Ben Bernanke:

I reluctantly cast a vote in favor of Ben Bernanke because I do not want to give President Obama the opportunity to put someone who shares his leftist views in charge of the Federal Reserve. I am aware of the mistakes that have been made at the Fed while Chairman Bernanke has been there, but I fear an alternative would be worse for the country’s economic future.

So our elected Marionette is simply trying to save us from having the president nominate someone else. Cute. Perhaps he should have engaged his brain and realized two simple facts – first, if Bernanke was not confirmed by the senate there is little chance that President Obama would have name a more extreme nominee (the natural reaction would be to nominate a safer pick); second, considering the makeup of the Senate (not to mention the final vote tally) opposing Bernanke would have been unlikely to prevent his confirmation but at least it would not have demonstrated approval for his performance (a vote to confirm sends that message more strongly than any press release about your supposed reluctance to cast the vote).

Bob Lonsberry Contradicts Himself on Term Limits

It’s not really fair to expect everyone to have an up or down opinion on a candidate within a week of their campaign being announced. For that reason there should be nothing surprising about the fact that Bob Lonsberry is not sold on Mike Lee (yet). As he aired his minor reservations with our latest 2010 Senate candidate he got talking about term limits – because Mike Lee thinks we should have a term limits amendment (perhaps like this one) – and Bob’s position completely failed to add up. At first I was planning to just comment on Bob’s site, but I felt that this deserved a full post.

There is a disconnect between Bob’s position on term limits and what he says later in his article. Here’s what he thinks of term limits:

Yes, people serve way too long in Congress. Yes, we have a professional political class right now. But the insinuation that the era of the Founders was much different doesn’t stand up to the test of history. Several of the Founders themselves held elected office for years on end. Some for the majority of their lives, and our Republic was benefited by their service.

And any person with Mike Lee’s knowledge of the Constitution must understand that an amendment mandating term limits would go against both the letter and the spirit of what the Founders wanted. Term limits don’t limit the freedom of politicians, they limit the freedom of the voters. We don’t need term limits, we have elections. And if Mike Lee, or someone else, can pose a viable alternative to Bob Bennett, and convince voters of that fact, the Constitution’s existing system for replacing politicians will work perfectly.

Later he makes this statement which exposes the weakness of his position:

I’m also bothered by Mike Lee’s age. Not that a 38-year-old can’t serve well in the Senate, but that he’s got so much life left. True, he is saying that people shouldn’t make a career of Washington, but so too did the two current Utah senators, both of whom have since made a career of Washington. Everybody running against incumbents is against long tenure in office. And everybody running for re-election believes in experience and seniority.

My concern is that at 38, Utah could be biting off something it will take 30 or 40 years to chew. I’m nervous about that.

The one selling point for 76-year-old Bob Bennett is that, at his age, he’s got a built-in term limit. He’s also, as they say, the devil you know. (emphasis added)

In case you missed the disconnect, Bob says that the founders already established a way to limit terms through regular elections and then worries that we might be stuck with Mike Lee for 40 years because he’s relatively young.

Here’s the half-truth that opens up the heart of the problem:

Term limits don’t limit the freedom of politicians, they limit the freedom of the voters. We don’t need term limits, we have elections.

It’s true that term limits limit the freedom of voters by eliminating the option to elect a president they like to a third term (to use our existing term limit as an example) – that’s the only freedom of the voters that is being limited. The problem is that the freedom of voters is already severely limited by our lack of term limits because of our political environment where potential candidates often choose not to challenge an incumbent, especially within their own party. For proof of that just look at how many more candidates tend to run for open seats. With term limits we would lose the option to vote for an incumbent after a set time, but we would gain so many candidates who currently choose not to run against an incumbent.

Bob claims that the founders did not want term limits and he’s probably right (although I doubt they ever addressed the issue to prove that conclusively) but they didn’t want parties either (they did make that clear) and we have parties anyway. The party system without term limits makes the regular election cycle a very weak way to limit terms – especially in a place where one party is dominant. Bob says that if someone can pose a viable alternative to an incumbent and convince voters of that fact then the system works perfectly. The question is, how can that happen when the potential candidates remove themselves from consideration because of the system that tilts heavily in favor of incumbents? And what makes a viable candidate? If a viable candidate is one that has the capacity and interest necessary to tackle the issues and do the job of a senator then I am a viable candidate. If a viable candidate is one that voters are likely to believe in that I am nowhere near viable. The first one should be the criteria, and if it were we would have lots of viable candidates for any office.

In a nation that probably has 80 out of 100 senate seats safely in the hands of one party or another and only about 20 seats that actually have a reasonable chance of changing hands from one election to the next the method of limiting terms that the Founders established is virtually impotent. The era of the founders may not have been much different than our era but it was different in some important ways. In this environment the Founders might find term limits to be a very reasonable method to ensure that the voters had the maximum amount of choice in candidates.

2074 Pages of Loopholes

With Thanksgiving weekend behind us all politically interested people can look forward to the Senate opening work on the healthcare bill. According to Senate Majority Leader Harry Reid:

. . . senators {will} work on weekends if necessary to hammer out compromises on thorny issues like a government-run insurance plan, abortion coverage and holding down costs.

“The next few weeks will tell us a lot about whether senators are more committed to solving problems or creating them,” Reid said.

I make no pretense that I have abandoned my day job and any semblance of a life to read through the entire 2074 pages of H.R. 3590 but I have read through the entire 13 page index of the bill and looked up a number of sections that either looked interesting or concerning to me. Of course my first question is how will this affect my health insurance situation (that may give some insight into the 12 sections I reviewed). The real question in this debate is whether there will be anyone who takes the time in the coming weeks (according to the story linked above we may expect up to 3 weeks of debate) to read the entire bill and break down what it actually means for consumers and the nation – going beyond the party-line soundbites that we will no doubt be subjected to constantly through the media for as long as the debate lasts.

After reading through my chosen sections I found seven that were interesting enough for me to write about them. (For anyone who is curious, there are approximately 350 sections to the bill – 50 times what I am doing today.) I will review them in the order they appear in the bill.

Constituent Communication Can Innoculate Against Insiderism

When I wrote about a legislator’s role as an information analyst the comments initially centered on Sen. Bob Bennett because of a quote I had used despite my desire to not single anyone out. Later in the comments on that post I made this statement that deserves to be elevated to its own post here:

In my opinion, the best defense against staying too long and becoming part of the problem is to maintain communication with constituents that is open enough for the constituents to indicate when the officeholder is compromising too much (or not enough in some rare cases) and the integrity to step aside when the officeholder finds that they consistently cannot act in accordance with the feedback they are receiving from constituents in good conscience.

Now that Senator Bennett has demonstrated a refusal to maintain open communication with constituents I am singling him out and exposing his refusal to communicate openly.

Fundraising Tells Us a Story

The third quarter just ended which means its time that the public can start learning how candidates have done on fundraising for the last quarter. The fundraising reports are pretty dry and generally boring. They always result in reports about which opponents in any given race are getting the most cash such as Bennett outpaces Shurtleff in fundraising, but the fundraising reports also tell us stories about the state of politics in general and specific races in particular.

The big race in Utah right now is the 2010 race for the senate seat currently held by Bennett. The story on that particular race is that Bennett is raising more money than Shurtleff or any of his other challengers. This should hardly surprise anyone because of his incumbency. Money spent on a challenger is a sign of support and hopes for what that challenger will do in the future if they win. It might also be a bit of a statement against the incumbent, but disappointment with the incumbent does not tend to appear as a large campaign donation to a challenger this early in the race. Money spent on an incumbent is support for the future and an opportunity in the present to weigh in on the issues between now and election day next year – that extra year of getting an actual legislator to listen to you is bound to attract more cash.

Bennett’s only Democratic challenger raised “about $19,600 in the third quarter” demonstrating that Utah is still solidly Republican and few people are even looking to the Democrats for serious consideration.

Another story in that particular rage is this:

A shotgun shooting event raised $88,600 for the Shurtleff Joint Fund. That total includes $25,000 from Provo-based company Success Multimedia, $20,000 from Nu Skin, and $10,000 each from EnergySolutions and USANA Health Sciences.

The fact that Shurtleff raises large chunks of cash from a few organizations for individual events tells us that Shurtleff is almost guaranteed to be the same type of politician as Bennett no matter how different he claims to be on the campaign trail. Some people will like that, others will not, but that’s the story told by the money. Hopefully nobody expects more than cosmetic change if Shurtleff succeeds in replacing Bennett.

It was a later portion of the article that tells the story of the state of politics generally:

The Hatch campaign traded in an old Cadillac for a newer, but still used, Cadillac, spending $36,900 at Young Chevrolet. The senator will use the car when he is in the state.

I doubt that there is anything unusual about this for a sitting member of Congress – which is what irks me. Do I have any reason to complain about how Hatch spends money that is not taken from taxpayers by force? No, but the story this tells is instructive.

I have no problem with Hatch buying a Cadillac. I have no problem with him spending more on a used car that I have spent on cars in the whole of my life. (I’ve purchased 3 cars myself and if you added those prices together plus all my repairs and gas purchased for the last 10 years it still probably comes out to less than $36K.) The thing I have a problem with is that we pay this man $180,000 a year – which should be enough to afford a car for D.C. and a car for Utah – and on top of that salary he still gets to use his campaign fundraising money as a permanent expense account. If he’s getting a $600,000 per year expense account (notice that his election is 3 years away right now and he’s still taking in over half a million per year) why are we paying him another $180,000? Is it any wonder that sitting members of Congress can so easily get completely out of touch with reality when we pay them that much and still allow them to take many of their basic expenses out of a completely separate fund?

If I believed that was an honest way to make a living I would start permanently campaigning for high profile offices as soon as I believed that I could attract even a fraction of the donations that Hatch receives in perpetuity.

The moral of the story about politics generally is that freeloading is alive and well at all levels of society – we give our leaders precisely what many people in society wish they had.

Senator Ted Kennedy

After a constant barrage of news coverage and a few questions from my own acquaintances asking about my views on Ted Kennedy I thought it appropriate to pay this tribute to The Lion of the Senate.

Few men have likely done more to earn the title of “Senator” in the history of our nation. I say this with all sincerity despite the fact that my own political views are very different from those espoused by Ted Kennedy. Of course I did not know him personally, but based on all the stories that are told of his work in the Senate (and I have seen no cause to doubt any of the accounts) he was a rare example of a Senator who truly understood the nature of the work that elected officials in the senate are called upon to do. Comparing him to others who hold or aspire to hold seats in the Senate consistently results in the others looking like pretenders.

He was well known for his ability to hold fast to his principles while still knowing how to work with people who did not agree with those principles. Our own Senator Hatch is a prime example. Despite any personal weaknesses he was willing and able to stand firm against any opposition to a position he held on principle. I believe it is because of his unwavering devotion to principle that I discovered that when he disagreed with Senator Hatch (who is ideologically closer to me than Kennedy is) at least half the time it was Kennedy that I agreed with – it was when the two of them agreed that I was more likely to disagree.

Perhaps the highest tribute I could give would be to share my belief that, in a nation where more people identify themselves as conservative than as liberal it was the sustained effort of this one principled liberal in the senate for the last few decades that has ensured that out government has moved inexorably toward more liberal positions. I hope that I can one day see a conservative Senator who works as hard and holds to his principles as well as Ted Kennedy did for so long.

The Trick to Choosing Elected Officials

In a letter to the Salt Lake Tribune Jeff Hammond offered this profound bit of insight:

As some politicians age, they grow into statesmen, like Barry Goldwater; others shrivel into petty party hacks. Sens. Hatch and Bob Bennett aren’t growing.

He’s right about Hatch and Bennett which is why it’s time to replace them. He’s also right about politicians who grow and shrink which is why we have to be very careful about who we replace them with. So far I am not confident that any one of the challengers for Bennett’s seat (Bridgewater, Eagar, Granato, Shurtleff, or Williams so far) will grow into a statesman. Some I have ruled out already as potential senators, others I am still considering. It’s an important decision that we must not make lightly. (I’ll bet that nobody can guess which ones I have ruled out even if I were to include Bennett in the mix and even if I said how many were already out.)

I hope that I will yet discover, either among the current challengers or among some as-yet-unannounced challenger, a real diamond in the making who will live up to the promise of every aspiring politician – to be a true statesman.

Bad Year for Liberty

I consider 1913 to be a very bad year for liberty because in that year the 16th and 17th amendments were both passed. Each of these amendments is a lever that loosened the moorings that had limited the power of the federal government for 126 years to that point. It’s true that before either of those amendments were passed the actions they authorized were already in use but by codifying the legality of an unlimited income tax and the direct election of senators removing even the appearance of states as sovereign political entities it became nearly impossible to lend any credence to the notion of limited national government held in check by the interests of state and local governments as well as the prevailing interests of the body of voters.

There are many conservative pundits calling for a scaling back of government. From what I have observed most of them seem to want to go back 30 or 50 years. Some may even be bold enough to suggest going back 80 years before the New Deal and the great depression. Very few understand that to truly have a limited government again we must go back at least 96 years to rest the two levers that were thrown in 1913.

Constitutional Amendment 17

Following close on the heels of the sixteenth amendment (both in terms of time and impact) comes what may well be the second most fundamental alteration to the public perception and operation of our government through the Seventeenth Amendment.

The Senate of the United States shall be composed of two senators from each State, elected by the people thereof, for six years; and each Senator shall have one vote. The electors in each State shall have the qualifications requisite for electors of the most numerous branch of the State legislature.

When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct.

This amendment shall not be so construed as to affect the election or term of any Senator chosen before it becomes valid as part of the Constitution.

This amendment might look fairly innocuous on the surface but it fosters a fundamental shift in the way that the people perceive the structure and function of the representation within the federal government.

I have written about this amendment before and I understand from the comments that some real problems had developed with the original setup of having state legislatures choose the senators. We cannot underestimate however the fundamental shift encoded in this amendment. In my state government I need to pay attention to one senator and one representative in the state government representing me. Before this amendment those two individuals were held responsible for how the state was represented in the United States Senate and then I would pay attention to my representative in the House of Representatives (replacing them if I felt poorly represented). Now the common perception (and the true fact sadly) is that the senators from each state are to represent the people of the state (so I have three people to keep my eye on in the federal level legislative branch besides the two I track in the state legislature) rather than representing the interests of the state as a sovereign political entity and being held accountable by the government of the state directly.

It is no wonder, with this amendment, that people today do not recognize that our structure of government was intended to be a representative republic – with the interests of the people balanced against the interests of each of the states – rather than a democracy.

Why Bob Bennett?

I went to the organizing convention for the Utah Republican Party on Saturday. While I was there in the nidst of hundreds of people campaigning for candidates and causes among the state delegates I made a point to talk to a variety of people sporting Bob Bennett t-shirts. With four primary challengers at present it is easy to see that the discontent with our incumbent is widespread. I believe that the reasons for supporting a challenger are not substantially different between those supporting Mark ShurtleffJames Williams, Cherilyn Eagar,  or Tim Bridgewater (in the order they will have officially announced) – I understand some of those generic reasons for seeking a change. What I wanted to understand was what motivated those who were actively supporting an embattled incumbent. I tried to present the question in a way that would get them to try to sell the candidate to me rather than leaving them feeling as if they (or their candidate) were being attacked.

I have to say that I was not very surprised by the answers that I received. I talked to more than two people and I always talked to them one-on-one so that one person would not influence the answers of another but they offered only two distinct reasons between them.  The first reason was the same one I heard from Senator Bennett back in February at a town hall breakfast meeting – seniority. (Some said experience but it amounts to the same argument.) The other answer I heard – and this would likely be even more disconcerting to many conservatives than seniority – was Bennett’s ability to work with Democrats. Personally I would rather support someone who would drown while trying to swim against the current than support someone who would stay afload by swimming with the current that was swiftly running away from the desired destination. Thankfully I think that we have candidates already in the race who can stay afloat while swimming upstream.

For those who are convinced that seniority is everything we can look to the freshman representative in Utah’s 3rd congressional district. Rep. Chaffetz has done quite a job of defending his positions and even getting bills passed without an ounce of seniority – and he’s earning quite a reputation for standing firm in his convictions which probably helps him to do more than if he were more prone to going along with the crowd. Some would argue that seniority is more important in the Senate than in the House – for those I would point to the example of a freshman senator from New York who was probably more influential in the Republican controlled senate of 2000 than our own two term Republican senator in that same senate. Seniority is not everything – it’s simply useful if you are headed in the right direction.
